Terms of Agreement

1. Introduction

These Terms of Agreement are entered into between LolaRoute (“the Agency”) and the person or entity booking travel services through the Agency (“the Traveler”). By confirming a reservation with LolaRoute, the Traveler agrees to all terms and conditions set forth herein.

2. Reservations and Payment
2.1. Booking Process: All reservations must be made directly through LolaRoute’s official website, via email, or through authorized travel representatives.

2.2. Payment Terms: Prices are quoted per person based on double occupancy. Single accommodations are available starting at $1,280 per person.
• A 25% non-refundable deposit is required at the time of booking to confirm a reservation.
• The remaining balance must be paid no later than 60 days prior to departure.
• If booking is made within 60 days of the tour’s start date, full payment is due at the time of booking and is non-refundable.

2.3. Late or Missed Payments: Failure to complete payment by the deadline may result in cancellation of the booking and forfeiture of the deposit.

3. Cancellation and Refund Policy
3.1. Traveler Cancellations:
• 120+ days before departure: Full refund minus $150 non-refundable deposit, or full Travel Credit.
• 90–119 days: 80% refund (minus deposit), or full Travel Credit.
• 60–89 days: 50% refund (minus deposit), or partial Travel Credit.
• Less than 60 days: No cash refund. Travel Credit or rebooking may be offered at the Agency’s discretion, based on recoverable costs.

3.2. Travel Credit Terms
• Valid for 24 months from issue date.
• Fully transferable and penalty-free.
• May be applied toward any future LolaRoute itinerary.

3.3. Non-Refundable Items: LolaRoute cannot provide refunds for unused travel services (e.g., meals, accommodations, activities), or for cancellations due to personal circumstances.

3.4. Cancellations by LolaRoute: In the event LolaRoute cancels a trip for any reason, Travelers will be offered a full refund or full Travel Credit, processed within 14 business days.

3.5. Force Majeure: LolaRoute is not liable for cancellations caused by events beyond its control, including natural disasters, political unrest, pandemics, or other extraordinary circumstances. In such cases, refunds or credits will be assessed based on the situation and recoverable costs.
3.6. Documented Emergencies: In cases of verifiable emergencies (e.g., medical), LolaRoute may consider partial refunds or credits on a case-by-case basis.

4. Travel Documentation
4.1. Passports and Visas: Travelers are responsible for securing and maintaining valid passports and visas for all destinations. LolaRoute will provide general guidance but cannot be held responsible for documentation issues.

4.2. Health Requirements: Travelers must comply with all health regulations and vaccination requirements of the destinations visited. While LolaRoute may offer assistance, final responsibility rests with the Traveler

5. Travel Insurance
5.1. Mandatory Coverage: All travelers are required to carry comprehensive travel insurance covering trip cancellation, medical expenses, and personal liability.

5.2. Proof of Insurance: Proof of valid insurance must be submitted to LolaRoute prior to departure.

6. Responsibilities and Liability
6.1. Agency Responsibility: LolaRoute is responsible for coordinating the trip as outlined but cannot be held liable for the performance of third-party suppliers, including airlines, hotels, or local operators.

6.2. Traveler Responsibility: Travelers must respect local customs, adhere to group schedules, follow guides’ instructions, and behave in a manner that ensures safety and a positive experience for all. LolaRoute is not liable for any losses or injuries resulting from Traveler behavior.

6.3. Limitation of Liability: LolaRoute’s total liability is limited to the amount paid by the Traveler for the tour. The Agency is not responsible for indirect or consequential damages.

7. Itinerary Changes
7.1. Changes by the Agency: LolaRoute reserves the right to make minor adjustments to the itinerary due to weather, logistical changes, or safety concerns.

7.2. Changes by the Traveler: Traveler-requested changes must be submitted in writing or directly to a destination specialist. While we strive to accommodate all adjustments, additional costs may apply based on availability and third-party terms.

8. Complaints and Dispute Resolution
8.1. Complaints: All complaints must be reported to the LolaRoute representative or trip leader during the trip to allow for on-site resolution.

8.2. Dispute Resolution: Disputes that cannot be resolved directly will be subject to mediation or arbitration under the laws of California, USA.
Liability Waiver and Release
In consideration of being allowed to participate in the activities and excursions offered by LolaRoute I, the undersigned, acknowledge and agree to the following:
1. Assumption of Risk
Travelers understand that travel involves inherent risks, including personal injury, illness, property loss, and unforeseen events. Participation is voluntary and at one’s own risk.
2. Release and Waiver
Travelers release LolaRoute and its staff from liability for any claims arising from participation in its tours, including those caused by negligence.
3. Medical Treatment
Travelers consent to emergency medical treatment if necessary during the tour. All medical and travel insurance coverage is the Traveler’s responsibility.
4. Legal Compliance
Travelers agree to comply with local laws in all countries visited. LolaRoute is not liable for legal consequences arising from Traveler misconduct.
5. Photo & Video Release
By participating in a tour, the Traveler grants LolaRoute permission to use photographs and videos taken during the trip for promotional purposes without compensation.
6. Severability
If any clause in this agreement is deemed invalid, all remaining clauses shall remain in full force and effect.
Governing Law
This agreement shall be governed by and interpreted in accordance with the laws of the State of California, USA.
We aim to handle all concerns with fairness, transparency, and respect. Good communication and mutual courtesy are essential to ensuring an enjoyable travel experience for all.
Acknowledgment and Acceptance
By booking with LolaRoute, the Traveler acknowledges they have read, understood, and agreed to these Terms of Agreement.

The Traveler further understands that availability is not confirmed until written confirmation is received from a LolaRoute Specialist.
